| 1. Registration of Member |
| In order to make use of the NESCAFÉ® KICK-START™ rewards programme available at www.kickstart.com.my you will need to register as a member with us. This service is open only to existing NESCAFÉ® KICK-START™ members and newly registered members via www.kickstart.com.my. This rewards programme is intended for Malaysian citizens only. Please refer to Nestlé Privacy policy for membership terms and conditions. |
| 2. Points collections (Rewarding activities) |
| Points will be recorded in a Member's Account, for activities done by the Member outlined in the rewarding activities set by Nestlé NESCAFÉ® KICK-START™. Nestlé will from time to time determine which are the qualifying activities and the number of Points that will be recorded in a Member's Account for such activities. Nestlé may from time to time offer exclusive promotions for specified groups of Members. Changes in the Points issuance rate and the offers, may be made without prior notification to Members for which Nestlé will not be held responsible. |
| 3. Bidding Activities and Points |
| Only the Member with sufficient NESCAFÉ® KICK-START™ Points is eligible to bid for items offered on the NESCAFÉ® KICK-START™ rewards programme. He/she may do so by using the bidding method implemented by Nestlé. Bidding orders once accepted by Nestlé cannot be revoked, cancelled, returned or exchanged, and the affected Points will not be reinstated. As a bidder, you are obligated to complete the transaction if you are the highest bidder at the end of the redemption period and your bid is accepted. By bidding on an item you agree to be bound by the conditions of bidder included in the item's description so long as those conditions of bidder are not in violation of this terms and conditions or unlawful. Bids are not retractable except in exceptional circumstances, such as: when a typographical error is made. Bidding is not open to employees of Nestlé Products Sdn. Bhd., the Organiser, the Sponsors, agencies and its subsidiaries, their business partners and their immediate family members. |
| 4. Bidding Method |
| To start bidding, the Member must place a pre-determined amount of NESCAFÉ® KICK-START™ Points for the rights to begin bidding on items. The LOWEST UNIQUE BID determined at the end of the bidding period will be declared the winner of the bid item. |

| 6. No warranties |
| We, officers, directors, employees and our suppliers provide our web site and services on an "as is" basis and without any warranty or condition, express, implied or statutory. We, officers, directors, employees and our suppliers specifically disclaim any implied warranties of title, merchantability, fitness for a particular purpose and non-infringement. |
| 7. Indemnity |
| You agree to indemnify and hold us and (as applicable) our parent, affiliates, officers, directors, agents and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this terms and conditions or the documents it incorporates by reference, or your violation of any law or the rights of a third party. |
| 8. Legal Compliance |
| You shall comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding your use of our service and your bidding on and redemption of items. |
| 9. Final decision |
| Bidders recognize that a successful redemption will only be concluded upon confirmation of acceptance by Nestlé NESCAFÉ® KICK-START™. Such acceptance is at the total discretion of Nestlé NESCAFÉ® KICK-START™ who shall have the final decision and selection of the bid without assigning any reasons whatsoever. Items are not exchangeable for cash. Nestlé NESCAFÉ® KICK-START™ reserves the right to substitute the redemption items offered with any other item of equal value, without any prior notice. |
| 10. Costs of Delivery and Delivery Policy |
| The costs of delivery will be borne by Nestlé NESCAFÉ® KICK-START™ except for members in Klang Valley who must make their own delivery arrangements. The delivery policy outlined on this website applies to addresses located in Malaysia only. For delivery outside Malaysia, the member must make their own delivery arrangements. |
